Splitting Up - know your rights

When a relationship ends there will always be pain and stress but seeking out proper professional support can be a vital step in helping you through the trauma of separation and divorce. At McCash and Hunter we can offer expert advice and guidance about arranging your affairs and making plans for the future at this confusing and difficult time.

A separation or divorce will mean making arrangements for your children, sorting out your finances, including pensions and life policies, and making a decision about where you are going to live. We can advise on all these subjects and on other matters that might cause concern.

If you are contemplating separation, or have recently been separated, we would suggest getting in touch with us at the earliest opportunity. We will then take time to discuss all of the aspects of the separation with you.

Talking through your situation will enable us to work towards a long-term settlement which your full entitlement on the breakdown of the marriage. We will arrange for the details of the settlement to be laid out in a comprehensive and legally binding separation agreement.

How much will a divorce cost?
Depending on your financial circumstances, you may be entitled to Legal Advice and Assistance (Legal Aid). We will always discuss the costs at the outset and advise you of our hourly rate if the fee is to be paid without the benefit of Legal Aid.

How long will it take?
The majority of couples now enter into a formal separation agreement which is followed by a Divorce based on the fact that they have not lived together for a period of two years. We do of course offer a full emergency service to deal with urgent Applications for Interdicts or Exclusion orders for victims of domestic violence or harassment.

What about the children?
Following a separation, parents can find it difficult to agree on the best arrangements for the care of their children. Ultimately, if the parents cannot agree on the arrangements an Application can be made to the Court to decide who the children should live with and how much time they should spend with their other parent. Disputed over these matters may also be resolved through Mediation.

What about maintenance?
The Child Support Agency may have to become involved unless you can reach an agreement on the amount of maintenance to be paid for the children. We can negotiate on your behalf.
